1. ARRANGEMENT OF SALE
1.1 ‘We’, ‘us’, ‘the business’ are JR Linton TECH LTD, 1 Trafalgar Square, Northumberland Avenue, London, WC2N 5BW, UK and ‘you’, ‘the customer’ are the person detailed on the order receipt and/or detailed on the credit/debit card used to make the purchase.
1.2 This arrangement becomes in effect the day we deduct the sale amount from your debit/credit card.
1.3 This arrangement includes any correspondence between you and the company and includes the products/services offered on our website.
2. PLACING AN ORDER
2.1 Browse our product range pages and select your chosen products.
2.2 Complete the order form in full and follow our detailed instructions on the website or call us on 0207 183 8883 and select option 1 and our sales team will take your order.
3. NEXT STEPS
3.1 If the product you selected is in stock your order will be loaded on the system. System stock updates are made every 5-8 hours and are not 100 percent accurate, we strongly suggest you email or ring Sales/Advice on 0207 183 8883 to check the latest stock update before placing an order. We will immediately deduct the price advertised for your selected products and charge this amount to your nominated debit/credit card, your purchased product(s) will then be dispatched to you; subject to stock and or availability. In the unlikely event the product is out of stock when your order was loaded onto our system, you will be offered the option of a similar product (in stock) with the closest specification from our range.
3.2 In the unlikely event your selected product(s) has not arrived after 6 business days after we have confirmed your estimated delivery date please inform us immediately. The following action(s) will be taken:
3.2.1 You may opt to cancel your order, in which case we will refund the original payment amount or
3.2.2 Request that we fulfill the order with a replacement product(s) (subject to availability) providing you return a set of the product you received, should you receive two sets or
3.2.3 Allow more agreed time for your order to turn up – if the agreed time has elapsed then options 3.2.1 or 3.2.2 will be available to you.
3.3 Should you choose to opt for option 3.2.1 your refund will be processed within 7 working days and credited to your nominated debit/credit card used during the original order process.
4. IF YOU ARE NOT HAPPY WITH YOUR PURCHASE
4.1 You may return the product to us in its original/sale-able condition within 15 days of the original order date after you have contacted our customer services team on 0207 183 8883 to obtain authorisation. You can then return the product(s) to us using the RMA number issued; if you have agreed for us to collect the product from you - we will do so from any address within the UK at a cost to you of £14.00.
4.1.2 Providing your returned goods is in a sale-able condition - a full refund will be authorised otherwise we will deduct up to 25% of the original sale value. In any instances where the product is returned to us and there is clear evidence you did not take care of the product while it was in your possession - whether or not the product was deemed to be faulty we will either deduct up to 25% of the original sale value or reject the returns altogether.
4.1.2.3 If the product is returned to us because of a reported fault but has been tested by our Engineers to not be the case; a £25.00 administration fee will be applied before the product can be returned to you.
4.2 The 35 days return period gives you entitlement to a full refund (see 4.1 & 4.1.2 above), a credit note or an exchange with a £10.00 carriage cost (UK only)
4.2.1 If you have opt for a refund this will be processed within 10 days of receipt of your returned goods. We regret that delivery charges cannot be refunded, we will deduct the initial credit card processing fee associated with your order.
4.3 Manufacturers will warrant the product from defects between 1 & 5 years (depending on manufacturer)
4.3.1 You may request for a replacement product – which will be dispatched to you (subject to availability) providing you were not satisfied with the original product.
4.4 We regret software or memory module purchases cannot be returned, please ensure you are purchasing the correct software or memory module for your needs before completing payment; you can get straight forward advice by phoning 0207 183 8883.
4.5 If your order differs from the actual product ordered - in which case we had made a 'dispatch error' we will raise an RMA to collect the product; if you choose to return the product at your expense, we will reimburse you by up to £6.00GBP.
4.5.1 If you have not signed for the product as damaged and you later need to return it to us after discovering it was damaged during transit, you will be requested to send us photos of both the outer packaging and the damaged product before we can have the returns signed off.
5. BASIS OF SALE
5.1 Any typographical, clerical or any other error or omission in any sales literature price list or offer or any other documents issued by us is subject to amendment by us where reasonable in all the mentioned circumstances to do so.
5.2 You are responsible for ensuring there aren't any errors on your purchase receipt/email.
5.3 The pictures of any product may not be its true representation and colors may vary in certain cases.
5.4 We reserve the right to cancel or refuse an order at our own discretion with or without reason.
6. PRICE OF GOODS/SERVICE
6.1 The price of goods shall be the price quoted by us on our website next to the product, unless agreed otherwise by us in writing.
6.1.2 If a pricing error is noticed before your order is shipped, we will en-devour to offer a full refund or the opportunity to purchase the product/service at the current recommended retail price.
6.2 The price you see is inclusive (the price you see is the price you pay) and includes any UK applicable taxes (VAT at the current rate).
7. RISK PROPERTY AND DELIVERY
7.1 Risk of damage to or loss to your selected product(s) shall pass to you on delivery of them.
7.2 Your selected product as outlined in the arrangement will remain the property of JR LINTON and will not pass to you until we receive cleared funds payment of the full price of your selected product(s).
7.3 We will not be liable in the eventuality of late deliveries should it concerns a direct responsibility with TNT, DPD, Royal Mail, Parcelforce, UPS or Yodel.
7.4 Upon receipt of your order, please ensure that everything is in good working order. If the outer packaging appears to be damaged please sign for as “damage” If there are any apparent faults, the buyer shall be entitled to return the product under the conditions set down in line 4.1 & 4.5.1 above.
8. LEGISLATION
8.1 This contract shall come under English law. We cannot be held liable for any kind of damages, material, immaterial or corporal, that arise as a result of the malfunctioning or misuse of commercial products.
8.2 The same shall apply where any alterations are made to products by their manufacturers. Our liability shall, in any case, be limited to the setting up of the product(s) and we may not be held liable in the event of simple errors or omissions which may occur in spite of all the precautions taken in presenting the products.
8.3 In the event of a dispute, our customer services division is at your disposal with the aim of reaching the fairest, amicable settlement. Failing this, the London Commercial Court shall be the only court with jurisdiction to rule on such disputes, regardless of the place of delivery or accepted method of payment.
9. WARRANTIES AND GUARANTEES
9.1 All goods sold benefit from the guarantee of conformity during a period of between 1 and 2 years, [see line 4.3] (Directive 1999/44/EC of the European parliament and of the council of 25th May 1999), beginning with the date of delivery, without any prejudice of applicable legal guarantees.
9.2 Return costs incurred during transit are to be covered by the customer.
9.3 Meanwhile the costs due to the return of the goods will be refunded if the guarantee of conformity is applicable to the returned goods.
9.4 Any returned product(s) MUST be accompanied by a copy of your proof of purchase.
9.5 Where we sell to you under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) your statutory rights are not affected by this Agreement.
10. FORCE MAJEURE
10.1 We shall not be liable to you or be deemed to be in breach of this Agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond our reasonable control:-
10.2 Act of God, explosion, flood, tempest, snow, adverse weather, fire or accident;
10.3 war or threat of war sabotage insurrection civil disturbance or requisition;
10.4 acts restrictions regulations bye-laws prohibitions or measures of any kind on the part of any governmental parliamentary or local authority;
10.5 import or export regulations or embargoes;
10.6 strikes lock-outs or other industrial actions or trade disputes (whether involving employees of us or of a third party);
10.7 power failure or breakdown in machinery.
11. GENERAL
11.1 If any provision of this Arrangement is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected thereby.
11.2 The Contract shall be governed by the laws of England.
12. WHOLE ARRANGEMENT
The terms and conditions set out in this Agreement represents the entire Agreement.
